Lalman Shukla v. Gauri Dutt Lalman Shukla
(1913) 11 All LJ 489; AIR 1913 All 489 · Allahabad High Court · 1913
PrincipleThere is no acceptance of an offer that the acceptor did not know about.
Facts
The defendant's nephew ran away. He sent his servant, Lalman Shukla, to search for the boy and afterwards announced a reward of Rs 501 for anyone who found him. Lalman found the boy before he learnt of the reward and later claimed it.
Held
The Allahabad High Court held that there can be no acceptance without knowledge of the offer. Lalman was already under a duty as a servant to search for the boy and did not know of the reward when he found him, so there was no contract and no claim.
