Court case[1915] AC 847

Dunlop Pneumatic Tyre Co. Ltd v. Selfridge & Co. Ltd Dunlop v. Selfridge

[1915] AC 847; [1915] UKHL 1 · House of Lords · 1915

PrincipleA stranger to a contract cannot sue on it.

Facts

Dunlop sold tyres to a dealer, Dew & Co., who agreed not to sell below list price and to obtain the same undertaking from their customers. Dew sold tyres to Selfridge, who gave that undertaking to Dew but then sold below list price. Dunlop sued Selfridge on the undertaking.

Held

The House of Lords held that only a person who is a party to a contract can sue on it, and that a person seeking to enforce a promise must have given consideration for it. Dunlop was neither a party nor a provider of consideration, and Dew had not contracted as Dunlop's agent.
